Terms of Service

Eligibility

You must be at least 13 years old to use TenderNest. If you are under 18 you confirm that you have your parent or guardian's permission. By using the app you represent that you meet these requirements. Any age declaration or date of birth you provide must be truthful. Confirming your age during registration is your declaration that you meet the minimum age requirement; it does not mean that TenderNest has independently verified your age. We may suspend or remove accounts that do not meet these requirements.

Your Account

• You are responsible for keeping your password secure and for all activity that occurs under your account
• You must provide accurate information when registering and keep it up to date
• You may not share your account with others or create accounts on behalf of someone else without their consent. The one exception is a parent or guardian creating a supervised account for their own child aged 13 to 17 (see Parental Controls below)
• Notify us immediately at info@tendernestapp.com if you suspect unauthorised access to your account

Acceptable Use

You agree not to use TenderNest to:

• Send content that is abusive, harassing, threatening, or hateful
• Send spam, unsolicited messages, or commercial solicitations
• Share content that is illegal, obscene, or infringes another person's rights
• Attempt to access, tamper with, or disrupt TenderNest's servers or infrastructure
• Impersonate any person or entity
• Use the service for any unlawful purpose

We reserve the right to suspend or permanently remove any account that violates these rules.

Content You Share

You retain ownership of the notes, photos, and voice messages you create. By sending content through TenderNest you grant us a limited licence to store and deliver it to your intended recipient. We do not claim ownership of your content and will not use it for any other purpose.

You are solely responsible for the content you send. Do not share content you do not have the right to share.

Connections & Blocking

Connections are mutual — both users must agree before notes can be exchanged. You can remove or block a connection at any time from within the app. Blocking a user prevents them from sending you connection requests or seeing your profile.

Parental Controls

Parental controls are free and let a parent or guardian supervise the connections of a young person aged 13 to 17. By linking accounts you accept the following.

• A parent can be linked in two ways: the young person creates a one-time code and gives it to their parent, or the parent creates an account for their child. A parent cannot link to an existing account without the account holder's code
• To act as a parent you must be at least 18 and the parent or guardian of the young person; you confirm this when you link. We do not independently verify this
• A parent can see the names and profile pictures of the people their child is connected to, approve or decline new connections, and remove connections. A parent cannot see notes, photos or voice messages, and no one can request them through parental controls
• When a connection involves a supervised account, it waits for the parent's approval before it becomes active
• When a parent removes a connection it is hidden for both people and can no longer be used. We keep the connection and its contents, unseen by either person, so that we can review it if there is a safeguarding concern
• A parent can release their child from parental controls at any time. A supervised young person can ask to be released, and we notify the parent
• While an account is supervised it cannot be deleted or have its email address changed by the young person; the parent releases the account first
• In a safeguarding situation, for example where we have reason to believe a parent is putting a young person at risk, we may end supervision without the parent's agreement

Subscriptions & Purchases

TenderNest offers optional paid plans (Plus and Pro) billed monthly or annually, and one-time message pack purchases. Payments are processed securely by Stripe; we do not store your card details ourselves.

• Subscriptions renew automatically at the end of each billing period until you cancel
• You can manage or cancel your subscription at any time from your Account settings
• Cancelling stops future renewals, but you keep your plan's benefits until the end of the period you've already paid for
• Message packs are one-time purchases and do not renew
• We may change prices for future billing periods; where we do, we'll give existing subscribers reasonable notice before it takes effect
• Purchases are generally non-refundable, except where required by applicable consumer protection law

Gifts

In the iOS and Android apps you can buy a gift (extra notes, or a year of Plus or Pro) for someone you are connected with. Gifts are purchased through the Apple App Store or Google Play and are subject to their payment terms.

• You can only send a gift to an accepted connection, and not to someone who has blocked you or whom you have blocked
• A gift is a one-off purchase and does not renew
• Gifts are non-refundable to the recipient and cannot be transferred, exchanged or redeemed for cash; any refund is made to the person who bought the gift, under the rules of the store they bought it from
• If a gift is refunded, we may remove the gifted plan from the recipient's account
• An optional message you add to a gift is shown to the recipient and is subject to the same Acceptable Use rules as notes
• A gifted year of Plus or Pro is added to the end of any gifted time of the same plan the recipient already has, and never lowers a plan they already have
• We limit the number of gifts one account can send per day to prevent abuse

Availability

We aim to keep TenderNest available at all times but we cannot guarantee uninterrupted access. We may suspend the service temporarily for maintenance or updates. We are not liable for any loss caused by downtime.

Termination

You may delete your account at any time from within the app's settings. Upon deletion your data is permanently removed. We may also suspend or terminate accounts that violate these terms, with or without prior notice depending on the severity of the violation.

Disclaimer & Limitation of Liability

TenderNest is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability to you for any claim shall not exceed the amount you have paid us in the 12 months preceding the claim.

Changes to These Terms

We may update these Terms from time to time. When we do we will update the effective date at the top of this page. Continued use of TenderNest after changes are posted constitutes your acceptance of the revised terms.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
